Draft — pending legal review
This text is a working draft prepared for review by a qualified lawyer. It is not legal advice and may not yet reflect the final terms.
1. General provisions
These Terms set out the rules for using the online shop operated by ST-serwis - spółka cywilna, 26-600, Radom, ul. Staromiejska 7, NIP PL7963021471, REGON 526505201 (the "Seller").
Contact: r-tuning@ukr.net, 508346721.
A Consumer is a natural person entering into a contract not directly connected with their business or professional activity. Certain consumer rights also apply to sole traders buying goods that are not of a professional character for them, under art. 385(5), 556(4) and 556(5) of the Polish Civil Code.
2. Placing an order and concluding the contract
- Add the goods you want to the basket and go to checkout.
- Provide the delivery address and contact details, choose a delivery method and a payment method.
- Review the summary: the goods, the total price including VAT, delivery costs and the delivery method.
- Confirm by pressing the button marked "Order with obligation to pay". Pressing it places an order that obliges you to pay.
The contract of sale is concluded when the order is placed. We then send an order confirmation to the email address you provided, containing the details of the contract on a durable medium.
Information on the website does not constitute an offer within the meaning of the Civil Code; it is an invitation to conclude a contract.
3. Prices
All prices shown are gross prices in the currency of your region and include VAT. Delivery costs are shown separately before the order is placed and are added to the total.
For deliveries outside the European Union, VAT is not charged (export). Customs duties and import taxes in the destination country are borne by the buyer and are not included in the price.
The price binding for an order is the price displayed at the moment the order is placed.
4. Payment
Payments are handled by our payment provider. We do not store your card details at any point.
If payment is not completed, the order is not processed. We start preparing the shipment once the payment is authorised.
5. Delivery
We hand the parcel to the carrier within 10 business days of the payment being authorised. Carriers, countries served and delivery times are described on the Delivery page.
The risk of accidental loss or damage passes to a Consumer only when the goods are handed over to the Consumer or to a third party designated by them other than the carrier.
6. Right of withdrawal
A Consumer may withdraw from the contract within 14 days without giving any reason. The procedure, the model withdrawal form and the exceptions are set out on the Returns page, which forms part of these Terms.
7. Conformity of the goods and complaints
The Seller is obliged to deliver goods that conform to the contract. If the goods do not conform, you may request repair or replacement and, in the cases set out by law, a price reduction or withdrawal from the contract.
The complaints procedure, including the address for correspondence and our response times, is described on the Complaints page.
8. Vehicle compatibility
Compatibility data shown for a part is guidance based on manufacturer and catalogue information. It does not replace verification against your own vehicle. Where a listing states restrictions (production years, engine variant, body type), those restrictions form part of the description of the goods.
If you are unsure whether a part fits, contact us at r-tuning@ukr.net with the VIN before ordering.
9. Out-of-court dispute resolution
A Consumer may use out-of-court means of handling complaints and pursuing claims, in particular by applying to the provincial inspector of the Trade Inspection (Wojewódzki Inspektor Inspekcji Handlowej) for mediation, or to a permanent consumer arbitration court.
Free assistance is available from the municipal or district consumer ombudsman and from consumer organisations. Information is published by UOKiK at uokik.gov.pl.
The European Commission's ODR platform ceased operating in July 2025 and is therefore no longer available as a route.
10. Final provisions
Matters not covered by these Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.
We may amend these Terms for valid reasons, such as a change in the law or in the way the shop operates. Orders placed before an amendment are governed by the Terms in force at the time the order was placed.
